Terms of Use
These Terms of Use govern the Aayu OS public website. Use of the Aayu transaction platform is also governed by the Clinic Participation Agreement, Business Associate Agreement, applicable pharmacy terms, and other agreements accepted during onboarding. Those specific agreements control if they conflict with this public summary.
Who we are
Aayu OS is operated by Om Healthcare Inc., located at 20330 N Deer Park Blvd, Suite 130, Deer Park, Illinois 60010.
Aayu is a technology and transaction platform. It is not a pharmacy, medical practice, healthcare provider, manufacturer, outsourcing facility, wholesaler, or distributor. Aayu does not prescribe, compound, dispense, warehouse, package, or ship medication and does not take title to medication.
What the platform does
Aayu allows eligible practices to review available products and prices, provide transaction information, submit eligible prescriptions or orders to participating pharmacies, select shipping, pay for transactions, receive available status information, and coordinate support.
The medication price displayed to a practice includes Aayu's margin. Shipping and any other applicable amounts are disclosed separately before submission.
The dispensing pharmacy is the seller of record for medication. Aayu collects payment from the practice and remits the pharmacy's applicable amount under the parties' agreements.
Independent pharmacies
Participating pharmacies are independent, separately licensed entities. Each pharmacy independently determines whether it may accept an order; what additional information it requires; whether and how it may compound, dispense, package, and ship medication; and what cancellation, refund, replacement, and reshipment terms apply.
Aayu may route information, administer the transaction, display available status, and coordinate a request. Aayu does not direct a pharmacist's professional judgment or guarantee a pharmacy-controlled outcome.
Eligibility
The platform is intended for authorized adult representatives and workforce members of eligible United States healthcare practices and participating pharmacies. It is not a consumer ordering service.
Basic registration does not guarantee account approval, pharmacy participation, product availability, state availability, or permission to order. Aayu may require business, identity, licensure, prescriber, payment, or other verification before allowing transactions.
Users must provide accurate information, use individual credentials, protect their accounts, act only within their authority, and comply with applicable law and agreements.
Practice responsibilities
Each practice is responsible for:
- The prescriber-patient relationship
- Clinical and prescribing decisions
- Required licensure, consent, and documentation
- Accurate patient, prescriber, order, and shipping information
- Determining whether an office-use order is permitted
- Reviewing the pharmacy, product, price, shipping, and terms before submission
- Managing patient pricing and patient payment outside Aayu
- Protecting and administering its user accounts
Medication information
Nothing on the website or platform is medical advice or a recommendation to prescribe.
Compounded drugs are not FDA-approved. FDA does not review compounded drugs for safety, effectiveness, or quality before they are marketed. A compounded drug is not a generic drug merely because it contains an ingredient used in an FDA-approved product.
References to 503A or 503B describe operating categories under federal law. They do not mean FDA has approved a particular compounded drug or endorsed a pharmacy, facility, product, or transaction.
Products may be added, removed, restricted, or suspended when availability, pharmacy participation, shortage status, licensure, regulatory policy, or eligibility changes.
Controlled substances, where offered, are dispensed only by pharmacies holding the required DEA registration and state licensure, and are subject to additional verification and ordering requirements.
Prices, shipping, and payment
Rates may change before submission and vary by product, pharmacy, state, order type, availability, and current commercial terms.
The medication price includes Aayu's margin. Shipping is selected and priced separately. The complete order total is displayed before submission.
By submitting a transaction, the practice authorizes the displayed charge to its selected payment method.
Pharmacy terms
Each transaction is subject to the terms of the identified pharmacy. Those terms may address order review, preparation, cancellation, refunds, shipping, address errors, cold-chain handling, replacements, reporting deadlines, and other limitations.
Aayu may coordinate requests and administer an approved payment adjustment. A request is not a confirmed cancellation, refund, replacement, or reshipment until the applicable pharmacy approves it.
Fulfillment information
Preparation, fulfillment, shipping, and delivery times are estimates or pharmacy- and carrier-provided information. They are not Aayu guarantees.
Privacy
The Privacy Policy describes Aayu's handling of website and business information. Protected health information handled on behalf of a practice is governed by the applicable Business Associate Agreement.
Do not send protected health information through ordinary email or public website forms.
Acceptable use
Users may not use Aayu unlawfully; submit false or unauthorized information; share credentials; access another organization's information; circumvent permissions or eligibility controls; introduce malware; interfere with the service; test security without authorization; or scrape or commercially exploit platform pricing, formularies, or content.
Availability
Aayu may modify, suspend, restrict, or discontinue part of the website or platform. The public website is provided on an "as is" and "as available" basis to the fullest extent permitted by law.
Aayu does not guarantee pharmacy participation, product availability, price continuity, pharmacy acceptance, dispensing, fulfillment, shipping, delivery, refund, replacement, clinical outcome, regulatory eligibility, or practice profitability.
